A Dominialidade das Terras Públicas como Requisito Jurídico para Proteção da Biodiversidade nas Unidades de Conservação: o Caso do Amazonas

O Amazonas possuía 56% com áreas protegidas para proteção da biodiversidade, e quase que sua totalidade em áreas públicas. A Lei 9.985/00 não dispôs sobre a dominialidade enquanto critério de criação das Unidades de Conservação (UC) - sejam terras públicas ou privadas . As UC têm sido criadas em sobreposição ou em territórios sem o domínio do ente titular, gerando insegurança jurídica, desentendimentos fundiários e conflitos. O objetivo deste artigo é discutir a importância da dominialidade das terras públicas e sua importância na proteção da biodiversidade nos territórios protegidos. As UC Sustentáveis podem ser criadas em áreas sem o domínio do titular, pois não ocorre transferência dominial, ao contrário das UC de proteção integral, salvo quando ocorrer a desapropriação. A não observância de tais critérios de dominialidade em terras públicas pode gerar insegurança jurídica e prejudicar a proteção da biodiversidade nestes espaços.
