A Teoria Discursiva em Habermas: um Debate com a Crítica Hermenêutica do Direito

O presente ensaio busca analisar questões relativas à teoria discursiva, na forma proposta por Jürgen Habermas, sendo que se pretende analisar sua teoria no âmbito da moral, a fim de permitir sua transposição ao Direito, no âmbito procedimentalista. A análise também é realizada com o intuito de verificar o porquê dos fundamentos da guinada linguística descrita no âmbito da perspectiva filosófica. Analisar-se-ão conceitos democrático-legislativos atrelados à fundamentação da cisão dos discursos de fundamentação e aplicação na teoria da decisão. Com isso, permitir-se-á uma abordagem da posição substancialista também fundamentada na filosofia da linguagem, a fim de colocar em evidência o viés linguístico existente na cisão dos discursos de fundamentação, na forma evidenciada por Lenio Luiz Streck.
