Dialética Histórica dos Direitos Humanos Fundamentais e Hermenêutica Diatópica

Neste trabalho será defendida a tese que os direitos humanos fundamentais são construídos historicamente na perspectiva cultural de cada povo e Estado Nacional. Por exclusão não se aceita a ótica do direito natural defendendo alguns direitos e princípios como sendo inerentes à natureza humana. É excluída como frágil e superficial a visão teórica ocidental universalizante dos direitos humanos apresentada pela carta da Declaração Universal dos Direitos Humanos das Nações Unidas. Face à realidade global composta por diversas culturas e tradições que apresentam diferentes costumes e valores procuram-se outras chaves de leitura. A teoria crítica dos direitos humanos de Herrera Flores será o nosso parâmetro teórico como fundamentação da tese acima citada. Também a teoria das janelas culturais e a hermenêutica diatópica de Raimon Pannikar nos parece ser um bom início para o estudo e compreensão da evolução dialética dos direitos humanos fundamentais nos diversos estados e culturas nacionais.
