A LUTA CONTINUA: direito à terra e desafios a regularização fundiária de territórios de povos e comunidades tradicionais no Brasil

O acesso à terra para povos e comunidades tradicionais pode ser viabilizado por meio de diferentes modelos de regularização fundiária no Brasil. Todavia, esses modelos são disponíveis a priori na legislação e não costumam contemplar as reivindicações dos grupos. Quando são desenvolvidos a partir e conquistados pelas mobilizações dos grupos tradicionais, tendem a sofrer processos de apropriação pelo Estado e por agentes externos e logo deixam de atender as demandas originárias a que se destinavam. Nesse sentido, há muita luta pela frente, no que tange aos desafios à regularização fundiária no Brasil. E este trabalho propõe algumas reflexões teóricas sobre esse tema. Com abordagem qualitativa, emprega o método dialético e utiliza a técnica da pesquisa bibliográfica, em que se privilegiou obras a partir dos anos 2000 e dos ramos das ciências sociais e jurídicas. A ideia é pensar instrumentos jurídicos de regularização que atendam as reais demandas – especialmente a regularização integral dos territórios tradicionais - e evitar a apropriação das reivindicações dos grupos tradicionais. Resta aos povos e comunidades tradicionais, como afirmo no título, continuarem na luta, fortalecerem suas estratégias e renovarem suas forças.Downloads
