A CONSTRUÇÃO DO CONCEITO DO DIREITO NA OBRA DE ROBERT ALEXY E SUA IMPORTÂNCIA NA FILOSOFIA CONTEMPORÂNEA

O presente artigo tem como objetivo apresentar uma visão geral acerca do conceito do direito desenvolvido na obra de Robert Alexy. Primeiramente, será apresentado o conceito do direito na filosofia jurídica, com a breve discussão da construção dessa definição ao longo da história, bem como a apresentação de diversas correntes, as quais auxiliaram na construção e embasamento nas teorias contemporâneas modernas do direito. Após, será analisado o conceito de direito apresentado por Alexy, suas principais críticas ao pensamento positivista e sua importância hodierna, no intuito de demonstrar a influência do seu pensamento na discussão acerca da relação do direito e da moral, e enfim chegar à conclusão de uma definição.
